Infosys was granted a summary judgment, including reimbursement for court costs, in a civil whistle-blower suit filed against the firm in US Federal court in Alabama. The complaint was brought by an employee alleging visa fraud and retaliation for disclosing improprieties. The court found that, while the visa case may have merit, and is in fact being investigated separately by a US grand jury, it was not germane to the issues before the court. This Research Note contains MR analysis of the court's findings, implications for clients, and potential hazards for Infosys and other India-based IT services firms ahead. The decision, complaint and other case documents are also included. (1,510 words)...More
The liquidating trustee in the (former) BearingPoint bankruptcy, John DeGroote Services, has survived motions to dismiss the $1.88 billion civil suit for fiduciary irresponsibility. The suit was filed against the firm's then-CEO, Edwin Harbach, and 8 members of BearingPoint's board of directors at the time. The suits are filed against them personally, since they allegedly acted in bad faith and breached their fiduciary duties, eliminating liability exclusions that would have been covered by insurance or BearingPoint governance policies limiting liability. The breaches alleged by DeGroote forced BearingPoint's shareholders and creditors to file bankruptcy in February 2009, later liquidating for just $396 million in net proceeds, when the company had an aggregate value of $2.3 billion 19 months before. A former CFO that left after just 3 weeks on the job offers telling perspective on the alleged misconduct. Research Note includes case details and offers rejected from competitors and priv...More
A civil lawsuit filed in US Federal court in Alabama against Infosys is about to turn into a nightmare for the firm, and likely for other India-headquartered consulting and IT service providers. Infosys stands accused of 6 civil charges by one of its consultants, associated with improperly using B-1 visas (not to be confused with H-1B visas) for workers coming into the US to work. The scheme alleged by Palmer was that for a foreign Infosys consultant to obtain a B-1 visa, an American employee of the firm had to write a "welcome letter" fraudulently stating that the employee was coming to the US for meetings rather than to work on a client engagement. Palmer seeks compensatory and punitive damages on the charges. A US federal judge ruled against Infosys' request for arbitration in November 2011. The trial is scheduled to begin on 20 August, with a pre-trial conference scheduled for 20 July. Research Note includes copies of complaint against Infosys; Infosys response; and detai...More
