According to Verdantix, in the last four years a combination of increasing energy expenditures, climate change policy, new market opportunities and shifting competitive dynamics has encouraged FTSE 100 firms to invest in more ambitious corporate sustainability strategies. Wellogix Prevails in Trade Secret Theft Case Against Accenture

MR - Accenture will likely pay around $49 million in compensatory and punitive damages to a former software and services partner, Wellogix, in a trade secret theft and misappropriation case involving SAP and their client, British Petroleum. The court's latest order lowers a $94.38 million jury verdict against Accenture in May 2011. The Texas jury found that Accenture intentionally misappropriated trade secrets from Wellogix, and then knowingly copied, communicated and/or transmitted them without Wellogix's permission. Wellogix has asserted that the associated acts drove it out of the business of providing complex process procure to pay software and services to energy clients. Accenture Acquires Controlling Interest in Al Faisaliah Business & Technology Company

Accenture has acquired a majority stake in Al Faisaliah Business & Technology Company (FBTC), a subsidiary of the Saudi Arabia-based Al Faisaliah Group. The joint venture combines FBTC's Middle East presence and skills in enterprise architecture, systems implementation and technology consulting, with Accenture's management consulting, technology and outsourcing expertise, industry competencies, global delivery capabilities, and focus on innovation. Accenture Posts Record Fiscal 2011 Q4 Results; 2011 Consulting Bookings Increase by 21 Percent

MR - Accenture has set a number of new records in Q4 and fiscal 2011 for the period ended 31 August. Accenture's fiscal 2011 Q4 net revenues were $6.7 billion, an increase of 23% in US dollars and 14% in local currency compared with the same 2010 period. Operating cash flow was $1.4 billion and free cash flow was $1.2 billion, both quarterly records. New bookings were $8.4 billion, Accenture's highest quarterly bookings in the firm's history. Consulting net revenues for Q4 were $3.9 billion, an increase of 25% in US dollars and 16% in local currency, compared with the fourth quarter of fiscal 2010. Consulting net revenues for fiscal 2011 were $14.9 billion, an increase of 21% in US dollars and 17% in local currency compared with fiscal 2010. Accenture finished fiscal 2011 with 236,000 people serving clients in more than 120 countries, with global net revenues of $25.5 billion (US). Accenture's extraordinary performance seems contrary to the global economic picture and economic projections for many of the markets it serves. Accenture's strategic focus remains clearly on the world's top performing and fiscally stable companies, who themselves are performing well in tough economic times. Accenture is also benefiting from a sourcing and procurement trend in management and IT consulting, outsourcing, and technology-based services where clients are rationalizing suppliers and placing more business with a smaller number of strategic suppliers. Accenture Settles Rille Qui Tam Suit with US DOJ for $63.675 Million

MR - Accenture has agreed with the U.S. Department of Justice to settle a whistle-blower suit filed in 2006 for $63.675 million. The Qi Tam lawsuit was originally filed by Rille and Roberts alleging that Accenture submitted false claims for payment under contracts with US federal agencies for IT consulting and services. The Justice Department characterizes the settlement as Accenture agreeing to resolve the claims that it received kickbacks for recommendations of hardware and software to the government, fraudulently inflating prices and rigging bids. Accenture continues to vigorously deny the allegations and says that the firm and the Justice Department have settled only to avoid the additional time, inconvenience and expense that would come with protracted litigation. The Accenture kickback allegations were part of a larger investigation of government technology vendors that has resulted in numerous settlements to date with firms that include IBM, PwC, CSC, Oracle, Hewlett-Packard, EMC, and Cisco. The total of the settlements paid by IBM, PwC, and CSC were around $6.5 million. That aggregated total was just a fraction of that paid by each of the firms that waited to settle. So there was clearly a significant premium charged to Accenture and the other firms that refused to address the risk early. Accenture's settlement, as well as that of Oracle, were in the range predicted by Monadnock Research in a September 2010 publication. MR - The business models of large consulting and technology product and service providers are in the early stages of a tectonic shift. Changes like this are infrequent in any marketplace, but technology products and services are utilized by clients in all sectors. Location-Based Rating Schemes for Consulting Services

MR - Some firms are willing to negotiate location-based rating schemes for strategic clients. So what are the average differences in rates for work provided exclusively at the client site when compared to rates for the same work provided at the firm site? Monadnock Research recently concluded an analysis of location-based rating (LBR) from more than 30 consulting firms that proposed 56 separate LBR schedules. Our study included analysis of 242 rate structures from 153 large and very large consulting firms providing services to the U.S. public sector to find those 56 schemes. Of the 153 firms, discounts were offered by 34 firms, primarily by level of professional providing services exclusively from the client facility. The study included rating schemes for IT Consulting, Management Consulting, Financial and Business Advisory Services, Human Resources Consulting, and Marketing Consulting. Nokia to Transfer Development and Support for Symbian Environment to Accenture

MR - Nokia will outsource its Symbian platform development and support activities to Accenture, including the transition of around 3,000 Nokia employees. The transaction remains subject to final agreement, and calls for Accenture to provide Symbian-based software development and support services as Nokia executes its strategic shift to the Windows mobile environment. The final agreement is expected to be concluded in the summer of 2011, and the transition of the Nokia staffers to Accenture should happen by the end of 2011. The affected employees are located in China, Finland, India, the U.K., and the U.S. Accenture acquired a Nokia professional services unit in October 2009 that provides engineering and support services for the Symbian environment to mobile device manufacturers and service providers. The firm says the Barcelona Analytics Innovation Center (AIC) will be a global showcase for Accenture's predictive analytics capabilities to clients visiting from around the world. MR - Italy's Consip SpA has awarded a consortium led by Accenture in partnership with PricewaterhouseCoopers a four-year, US$6 million contract to develop, implement, and maintain an eProcurement system. Accenture says it will provide Consip with management consulting and IT services to oversee the development and maintenance of a new procurement system. The system will help Consip leverage the latest eProcurement technologies and processes to reduce expenses and transform Italy's public sector procurement methods, processes, and operations. Consip is a public company based in Rome that was founded in 1997 by its sole shareholder, the Italian Ministry of Economy and Finance (MEF), and provides technology consulting on organizational and procedural projects for Italy's government. The City of London has awarded Accenture a five-year contract to help reduce procurement costs by more than £30 million over five years, creating a world-class procurement shared service center. Oracle Reaches $46 million Settlement with U.S. Justice Department in 2004 Sun Systems Integrator Whistleblower Suit

MR - Oracle has agreed to pay $46 million to the U.S. to settle claims that Sun Microsystems, who completed its merger with Oracle a year ago, independently and in complicity with systems integrators, submitted false claims to the General Services Administration (GSA) and other federal agencies on its behalf. The settlement resolves allegations under the False Claims Act and Anti-Kickback Act that Sun paid systems integrators kickbacks to recommend the purchase of Sun products by federal agencies. It was also in the range predicted by MR in September 2010. According to the allegations in the original qui tam whistleblower suit, Sun executed agreements with consulting firms that provided for the payment of related fees. The suits were filed by Norman Rille and Neal Roberts in September 2004, and were intervened by the U.S. Justice department in April 2007. The settlement also resolves claims that Sun's 1997 and 1999 GSA contracts were improperly priced because Sun misrepresented information to GSA contracting officials during negotiations. It also settles claims that incomplete and inaccurate information submitted by Sun resulted in defective pricing of its contract with the U.S. Postal Service and GSA contracts held by two Sun resellers. The Sun kickback allegations are part of a larger, ongoing investigation of government technology vendors that has resulted in six settlements to date with firms that provide consulting and systems integration services. One of the most significant trends Accenture identifies is the end of viewing everything through an application lens. The roles of application and data will be reversed, with data becoming the platform that supports application services. Architectures will be selected primarily to cope with soaring volumes of data and complexity of data management, not to support applications. Relational databases will make way for streaming databases, and social media will evolve into social platforms. MR - Accenture reported strong financial results for its 2011 fiscal first quarter, ended 30 November 2010, with net revenues of $6.05 billion, an increase of 12 percent in U.S. dollar terms and 14 percent in local currency over Q1 2010. The results exceeded guidance. Consulting net revenues in the period were $3.57 billion, an increase of 14 percent in U.S. dollar terms and 16 percent in local currency over Q1 2010. New bookings for the quarter were $6.31 billion, with consulting bookings of $3.72 billion. Utilization remained high at 87 percent, up one percent in the prior period, but down by that same amount from Q1 2010. Attrition for the period was 15 percent, down by two percent from Q4 2010, but up by 3 percent from Q1 fiscal 2010. MR - Accenture reported strong results for Q4 fiscal 2010, ended 31 August, and full-year results that were in line with guidance. Q4-2010 consulting net revenues were $3.09 billion, up 6 percent in U.S. dollar terms and 9 percent in local currency versus Q4-2009. Consulting net revenues for the year were $12.37 billion, a decrease of 1 percent in USD terms and down 4 percent in local currency from 2009. Net revenues in Q4 were $5.42 billion, an increase of 5 percent in USD and 8 percent in local currency. Net revenues for 2010 were $21.55 billion, flat in USD terms and a decrease of 2 percent in local currency from 2009. Net income for 2010 was $2.06 billion, compared with $1.94 billion, which included a restructuring charge recorded in Q4-2009. Fiscal 2010 consulting new bookings were $13.6 billion, up 7 percent in USD and 3 percent in local currency. Consulting represented 55 percent of new bookings. Accenture now has 204,000 staff, adding 64,000 in the year, not accounting for attrition. More than half were in its global delivery network. Utilization for 2010 was high at 87 percent, compared with 84 percent in 2009, but it was down to 86 percent in Q4-2010. MR - The U.S. Department of Justice (DoJ) has reached an agreement with Hewlett-Packard where HP will pay $55 million to settle allegations that it defrauded the General Services Administration (GSA) and other federal agencies. Previous guidance by HP estimated the amount at $47 million. HP has denied that it violated any laws in its settlement. The agreement, and the recent $87.5 million settlement involving EMC in an associated case, highlights the stiff penalty the DoJ is imposing on firms when they deny their failure to comply with Federal procurement guidelines for products and services.
