Fair Use
The most common reason why people mistakenly believe a particular use may be authorized is that it is justified under "fair use."
The excerpt below is from § 107, limitations on exclusive rights of fair use, from the U.S. Code, Title 17, Copyright Law. MR IP is also protected through international reciprocity agreements governing intellectual property.
U.S. Code, Title 17, Copyright Law, § 107, limitations on exclusive rights of fair use:
Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include --
(1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
(2) the nature of the copyrighted work;
(3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
(4) the effect of the use upon the potential market for or value of the copyrighted work.
The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors.
MR content is not made available to the general public in any library or research institution. Clearly no fair use of MR IP can be asserted by any public or private entity, except for properly cited works that MR has authorized via license to clients; or by authorized release for republication to research partners; or releases to representatives of the press for promotional purposes.
Since all clients of MR are commercial entities or public services institutions, even the research libraries within those entities, clients profit from each infringement and deprive MR from its only source of income, while increasing the revenue or decreasing the expenses of the client organization. Each improper use of MR intellectual property diminishes the content artifact's current and future value. Acts of willful infringement also carry significantly higher penalties.
Violations
All violations of MR intellectual property (IP) licensing policies are brought to the attention of client management at the highest levels when an internal violation is reported. Beyond protecting our ability to generate future income, MR is obligated to enforce its IP rights to ensure future protection. Matters that cannot be equitably resolved in a timely manner are litigated.
We encourage individuals to report violations of our IP guidelines. All reports are treated as confidential. We will never disclose the identity of individuals making reports, regardless of the value to us of a proper remuneration for services. Contact us to report a suspected violation.
