Terms of Use and Service

We invite you to explore the content and features available for free and to paid subscribers on MonadnockResearch.net. But before you do, please read our Terms of Use and Service carefully.

By accessing this site you agree to be bound by the terms detailed here. If you do not agree, do not proceed to access this site, or any of its content. Monadnock Research (MR) reserves the right to modify the Terms of Use and Service at any time without notice. Your continued use of MonadnockResearch.net means that you agree to these terms and any subsequent updates.

  1. Personal Use: All Memberships, including Memberships for employees of enterprise clients, are credentialed to specific individuals. Members are not permitted to share login credentials, including user names and passwords, or any site content, with any other individual at any time.

  2. Enterprise Memberships: Organizations that have purchased company-wide licenses have rights to a specific number of employee Member accounts, and each one must be assigned by MR to a specific named user. Please contact us via this link to add a new Member account at an organization with an enterprise subscription, or to inquire about enterprise Membership.

  3. Membership Transfer: Members have the right to transfer their Membership to another individual within their organization at any time during the subscription period at no cost, provided they contact Monadnock Research to facilitate that transfer. The Member portal monitors IP addresses and is designed to detect sharing of credentials. The system will automatically suspend any account where more than one individual signs on using the same user name and password.

  4. Service Buyer and Provider Access Rights: Buyers of consulting services have access to all Member areas of MonadnockResearch.net. Providers of consulting services may also subscribe, but individuals that market services are not granted rights to view or participate in discussion forums. Client organization Members receive instructions for accessing forums after subscribing.

Providers of consulting services have access to most, but not all content in the document archive. We understand that some organizations have employees that buy consulting services and others that market services. Members that are buyers of consulting services (or internal providers of consulting services) within organizations that also market services, may access all buyer areas. But in so doing, each hereby agrees that they will not share information obtained from buyer forums or buyer-specific content archives with members of their organization that provide services to external clients or support related activities. Members employed by financial services firms, software companies, and other organizations that offer services to either the consulting industry or to buyers of consulting services have the same access rights as those available to consulting service providers.

  5. Forum Rules: Members expect to be communicating with peers at other organizations, and Monadnock Research makes its best efforts to ensure that only our staff and buyers of services are allowed to participate in the forum areas of the site, on the CS:SPI group on Linked-In, or anywhere else where we host forums. No advertising, trading of goods or services, or other commercial use is permitted. No bulk e-mail, junk mail or spam, chain letters, or repeat postings of the same message is permitted anywhere within forums.

Forum participants are encouraged to disclose their name and organizational affiliation when posting to discussions, but we do not require it. Impersonating any individual or entity affiliation is strictly prohibited. MR personnel will always disclose that they are a staff member in forums. Treat other Members with courtesy and respect when posting messages or otherwise communicating. We do not edit or monitor all messages posted in discussion forums, but we reserve the right to edit or remove objectionable material. The individual posting a message is solely responsible for its content, and Monadnock Research makes no assertions as to the accuracy or fitness for a particular purpose.

  6. Confidentiality: Monadnock Research is a research and publishing firm, provides advisory services, and hosts networking groups and events. Our focus is on facilitating best practices for the procurement of management and IT consulting services; on assessing the practice area competencies, rates, client satisfaction, and industry and geographic areas served by providers of consulting services; on publishing news and conducting analysis regarding trends and industry developments; and on maximizing value from client engagements and strategic firm relationships. MR's business model is to facilitate the exchange of information between those stakeholders.

When Members and non-Members participate in a survey or interview, post content in a discussion forum, or otherwise engage in a discussion with MR staff, or with another Member, and where the specific information is not identified in writing as confidential, it will not be treated as confidential. Given the nature of our business, all confidentiality agreements between our firm and buyers or sellers of consulting services are event-specific. We have no blanket confidentiality agreements with any organization that is not a business partner. And each business partner has agreed to confidentiality terms with MR that binds them to any current in-force confidentiality terms.

The obligations of MR, with respect to protecting the confidentiality of information that has been identified in writing as confidential, are not applicable if that information:

    (a) Was, at the time of disclosure, otherwise known by MR without restrictions; or
    (b) Can be shown by MR to be either in the public domain at the time of receipt, or that it came into the public domain thereafter through no act of MR in breach of any agreement; or
    (c) Was disclosed to MR on an unrestricted basis by a source other than the party asserting confidentiality, which source has no duty of confidentiality with respect to the information that was known by MR at the time of disclosure; or
    (d) Was contained within a record in MR's files prior to the date of its receipt from the party asserting confidentiality; or
    (e) Was disclosed or used with the prior written approval of the party asserting confidentiality; or
    (f) Can be demonstrated in written record by MR to have been developed independently of disclosures made by the party asserting confidentiality; or
    (g) Was disclosed by MR in response to a legal mandate by order of a court or administrative body, after MR promptly notified the party asserting confidentiality and provided a reasonable opportunity to oppose such order.

  7. Grant of License: Information communicated will be employed broadly to encourage on-topic discussion; enhance the collective understanding of community members on related subjects; and to encourage development and employment of best practices. It is our policy not to attribute the name of an individual or organization without their prior consent.

Members hereby grant to Monadnock Research LLC and its successors and assigns the complete, perpetual, non-exclusive right to use, reproduce, modify, adapt, translate, distribute, and sub-license any related content and derivative works, in whole and in part, on a royalty-free basis.

  10. Dispute Resolution: The parties agree that any dispute arising under this agreement will be subject to binding arbitration with the American Arbitration Association, or any other arbitrator that is mutually agreed-to by the parties. The parties agree that this agreement shall be governed by, and construed and interpreted in accordance with, the laws of the State of Delaware, U.S.A. Unless mutually agreed by the parties, all arbitration proceedings will be held in Delaware. Judgment on any award rendered by the arbitrator may be entered in any court of competent jurisdiction.

  11. Injunctive Relief: The parties acknowledge that irreparable injury may result from the failure of either party to comply with the terms of this agreement. The arbitrator will have the authority to grant injunctive relief and specific performance to enforce compliance with the terms of this agreement.

  12. Severability: In the event that applicable law prevents the exclusion of liability for certain provisions of this agreement, or the exclusion of other stipulated terms of this agreement, the other agreement terms remain in full force and effect.

Failure to abide by these Terms of Use and Service can include, in addition to civil and criminal liability and associated remedies, the termination of access to the site for the offending party and all users in that individual's organization, without refund or recourse. No other agreement between Monadnock Research and any Member, Member organization, or any third party, shall supersede these Terms of Use and Service.
