BAE Systems Reaches Settlement with U.S. and U.K. Governments Over Bribery Charges Monadnock Research - 5 February 2010
MR - BAE Systems has reached settlements associated with a U.K. Serious Fraud Office investigation first disclosed by BAE in November 2004 and a U.S. Justice Department investigation disclosed in June 2007. The agreements, if approved by courts in the U.K. and U.S., call for BAE to pay £30 million in a combined fine to the U.K. Government and as a charitable contribution to benefit Tanzania, and to pay the U.S. a fine of $400 million and make assurances of future regulatory compliance. BAE admits to paying bribes to a marketing consultant in 1999 to secure a radar system order from the government of Tanzania. (401 words) . . . More
Sky Broadcasting Wins Fraud Ruling Against EDS/HP Over Failed Consulting Project Monadnock Research (VII N5) - 28 January 2010
MR - British Sky Broadcasting (Sky) has won a partial victory in its 5 year legal battle against HP Enterprise Services UK Ltd., the U.K. successor to Electronic Data Systems. The court found EDS guilty of deceit, negligent misrepresentation, and breach of contract. Former EDS CRM practice Managing Director, Joe Galloway, was found to have lied to Sky in order to secure a £47.64 million contract for a CRM system that ultimately cost Sky £265 million. In a now-notorious court incident, the former SHL Systemhouse executive was found to have committed perjury in defending his mail-order M.B.A., when Sky's council secured identical credentials in minutes for his dog at trial. Deloitte Agrees to Acquire Property Advisory, Drivers Jonas Monadnock Research – 27 January 2010
MR -- Deloitte says it hopes to create a new model in the real estate advisory market with the acquisition of Drivers Jonas. Founded in 1725, Drivers Jonas is the UK's oldest property advisory firm. IBM Global Business Services Revenues Down 10 Percent for 2009, but Margins Up Monadnock Research - 21 January 2010
MR - IBM's Global Technology Services revenue was down 4.9 percent in U.S. dollar terms to $37.35 billion, but GTS gross margins increased by 2.4 percent to 35 percent. Global Business Services revenues decreased by 10.1 percent to 17.65 billion, with GBS gross margins increasing by 1.5 percent to 28.2 percent. Total revenues for IBM were down by 7.6 percent from $103.63 billion to $95.76 billion. Despite the revenue declines, in services revenues in particular, IBM managed to increase net profit margins by 8.8 percent to $13.43 billion, primarily driven by its shift to higher margin products and services and execution of strict expense management. CACI Fights Back Against Critical New York Times Editorial Monadnock Research - 21 January 2010
MR - CACI International has demanded a retraction and correction to an editorial published in the 11 January print edition of the New York Times. CACI claims that the Times editorial improperly characterized its contractors who worked in Iraq as mercenaries while commenting on a matter involving a private security group working at Abu Ghraib prison. According to the Times editorial, "The army has said contractors from firms like CACI International Inc. were involved in more than a third of the proven incidents of abuse in 2003 and 2004 in the Abu Ghraib prison." CACI says the statement is "maliciously false," and calls on the Times to "more faithfully execute its responsibility to deliver the news fairly and accurately." New Study Maps a Decade of Shrinking IT Innovation Monadnock Research - 20 January 2010
A.T. Kearney - While industry leaders overwhelmingly acknowledge the value of IT as an important strategic differentiator, investment in IT innovation misses the target more than 75 percent of the time, according to the results of a recent study from A.T. Kearney. The new study, entitled "Delivering Technology Innovations," also found that, while investments targeting innovation accounted for 30 percent of the average IT budget in 1999, it has fallen to 14 percent today. Of the companies with more than 10 percent annual growth, the number that benefited from IT innovation reached nearly 90 percent. (615 words) . . . More

Companies Take Steps to Prepare for New Executive Compensation Regulations Equilar - 7 January 2010
MR - An analysis of 1250 S&P 1500 companies found that 235 disclosed the phrase 'excessive risk' in their compensation discussion and analysis (CD&A) for 2009, compared to only two companies in 2008, according to a report from Equilar. Effective February 2010, most companies that are required to report to the U.S. SEC will need to increase disclosure of information about their consultant relationships. In a study of consultant relationship transparency under the old regulations, only around 3 percent of companies disclosed any fee information. (525 words) . . . More
